Special Town Meeting on Monday regarding recreational marijuana

Dear fellow Hanoverians:

File this under “in case you missed it”! It is a busy time of the year, so
I would not be surprised. :) On Monday, December 18th, at 7:00 p.m. there
will be a Special Town Meeting at Hanover High School Auditorium. Please
join us as this is an important issue for the town.

Last November, we were the second highest “no” vote total in the
Commonwealth regarding the legalization of recreational marijuana. By a
vote of 58% to 42%, we voted against the measure. As you surely know,
however, the ballot question won state-wide, and recreational marijuana is
coming to Massachusetts next year.

Cities and towns that voted against recreational marijuana, like Hanover,
now can choose whether or not to allow recreational marijuana sales within
their borders.

There are two questions on the warrant next Monday, as follows:

ARTICLE 1. PROHIBITION ON MARIJUANA ESTABLISHMENTS – ZONING BYLAWS
In accordance with Massachusetts General Laws Chapter 94G, Section 3(a)(2),
all types of marijuana establishments, as defined in Massachusetts General
Laws Chapter 94G, Section 1 and as may otherwise be defined by
Massachusetts law or regulation, to include, without limitation, all
marijuana cultivators, marijuana testing facilities, marijuana product
manufacturers, marijuana retailers, on-site consumption of marijuana at a
marijuana retailer location, any other types of licensed marijuana-related
businesses, and the conducting of any such activity for commercial purposes
by whichever name used, shall be prohibited within the Town of Hanover.
This prohibition shall not be construed to affect the medical use of
marijuana as expressly authorized by the provisions of Chapter 369 of the
Acts of 2012 and 105 CMR 725.000, as may be amended from time to time, or
take any other action relative thereto.

As of this writing (Saturday morning), the motion on this article will be:

We move that the Town of Hanover amend the Town of Hanover Zoning Bylaws to
include the following as:

Section 6.16.0 – PROHIBITION ON MARIJUANA ESTABLISHMENTS.

In accordance with Massachusetts General Laws Chapter 94G, Section 3(a)(2),
all types of marijuana establishments, as defined in Massachusetts General
Laws Chapter 94G, Section 1 and as may otherwise be defined by
Massachusetts law or regulation, to include, without limitation, all
marijuana cultivators, marijuana testing facilities, marijuana product
manufacturers, marijuana retailers, on-site consumption of marijuana at a
marijuana retailer location, any other types of licensed marijuana-related
businesses, and the conducting of any such activity for commercial purposes
by whichever name used, shall be prohibited within the Town of Hanover.
This prohibition shall not be construed to affect the medical use of
marijuana as expressly authorized by the provisions of Chapter 369 of the
Acts of 2012 and 105 CMR 725.000, as may be amended from time to time.

Laws Chapter 94G, Section 1 and as may otherwise be defined by
Massachusetts law or regulation, to include, without limitation, all
marijuana cultivators, marijuana testing facilities, marijuana product
manufacturers, marijuana retailers, on-site consumption of marijuana at a
marijuana retailer location, any other types of licensed marijuana-related
businesses, and the conducting of any such activity for commercial purposes
by whichever name used, shall be prohibited within the Town of Hanover.
This prohibition shall not be construed to affect the medical use of
marijuana as expressly authorized by the provisions of Chapter 369 of the
Acts of 2012 and 105 CMR 725.000, as may be amended from time to time.

In order for the Zoning Article to pass, it needs a 2/3 vote. In order for
the General By-Law Article to pass, it needs a simple majority. Given our
vote in November 2016 (of 58% against and 42% in favor), that makes turnout
on Monday a very important issue! Hope to see you there!
