PLANNING BOARD<\/p>\n
NOTICE OF PUBLIC HEARING<\/p>\n
Notice is hereby given pursuant to Massachusetts General Laws Chapter 40A,
\nSection 5 (The Zoning Act), that the Planning Board of the Town of Hanover
\nwill hold a Public Hearing on Monday, March 9, 2009 at 7:00 p.m. in the
\nfirst floor hearing room of the Town Hall, 550 Hanover Street, Hanover, MA.<\/p>\n
The purpose of the Public Hearing is to hear testimony and comment from
\ninterested persons relative to proposed amendments and additions to the
\nZoning Bylaw and General Bylaws for the Town of Hanover, said amendments
\nhaving been included as Articles on the Warrant for consideration and action
\nat the Annual Town Meeting to be convened at the Hanover High School on
\nMonday, May 4, 2009. After the Public Hearing the Board will, as required
\nby law, vote its recommendations on the proposed articles and report them to
\nthe Town Meeting.<\/p>\n
There are ten (10) Articles proposing amendments to the Zoning Bylaw and
\nrelated General Bylaws for the Town which pertain to zoning and planning. A
\nsummary of the proposed Articles is provided below. Copies of the text of
\nsuch Articles and maps thereof are available for review by interested
\nparties in the Offices of the Town Clerk and of the Planning Board (550
\nHanover Street, Hanover, MA 02339) during regular business hours, 8AM to
\n4PM, Monday through Friday. The Article items appearing below may not be
\nthe same as those on the final Warrant for the Annual Town Meeting, and are
\ninserted herein for convenience and discussion purposes only.<\/p>\n
Summary of Proposed Zoning Articles:<\/p>\n
Article A: This Article, submitted by Petition, would amend the
\nZoning Bylaws of the Town, by changing photocopying, hairdressing and beauty
\nshops from uses which are currently prohibited within the Town’s Aquifer
\nProtection Zone to uses which are permitted, subject to a issuance of a
\nSpecial Permit from the Planning Board.<\/p>\n
Article B: This Article, submitted by the Planning Board, would amend
\nthe Zoning Bylaws of the Town, by decreasing the amount of parking spaces
\nrequired based on retail space within the Planned Shopping Center District,
\nwhere the Hanover Mall is located. The proposed change would allow the
\nconversion of excess parking lot areas into useable building space.<\/p>\n
Article C: This Article, submitted by the Planning Board, would amend
\nthe Zoning Bylaws of the Town, by requiring a Special Permit to operate a
\nBody Art or Tattoo Establishment, and by requiring such uses to be located
\nwithin the existing Adult Use Zoning District.<\/p>\n
Article D: This Article, submitted by the Planning Board, would amend
\nthe Zoning Bylaws of the Town, by requiring a Special Permit and Site Plan
\nApproval to construct and operate a Wind Turbine in the Town in any Zoning
\nDistrict. Currently no regulations are in place for Wind Turbine uses.<\/p>\n
Article E: This Article, submitted by the Planning Board, would amend
\nthe Zoning Bylaws of the Town, by allowing Assisted Living Facilities within
\nthe Planned Shopping Center District, where the Hanover Mall is located,
\nsubject to issuance of a Special Permit from the Planning Board.<\/p>\n
Article F: This Article, submitted by the Planning Board, would amend
\nthe Zoning Bylaws of the Town, by allowing wetland resource and riverfront
\narea in the calculation of dimensional regulations within the Planned
\nShopping Center District.<\/p>\n
Article G: This Article, submitted by Petition, would amend the
\nZoning Bylaws of the Town, consistent with Chapter 169 of the Acts of 2008
\n(An Act Relative to Green Communities) to provide for the as-of-right siting
\nof renewable or alternative energy research and development facilities, and
\nrenewable or alternative energy manufacturing facilities within the
\nindustrially zoned Fireworks District, subject to Site Plan Approval by the
\nPlanning Board.<\/p>\n
Article H: This Article, submitted by Petition, would amend the Zoning
\nBylaws and Zoning Map of the Town, by changing the Zoning Designation of the
\nwesterly portion of parcel 48-006 (596 Washington Street) from Residence A
\nDistrict to Commercial District, so that the entire parcel shall be zoned
\nCommercial District.<\/p>\n
Article I: This Article, submitted by The Board of Selectmen would
\namend the Zoning Bylaws of the Town, to require that the setback for all
\nfences and corrals meant for animal and livestock containment meet the
\nfront, side and rear setback requirements for structures under the Zoning
\nBylaw.<\/p>\n
Summary of Proposed Non-Zoning Articles:<\/p>\n
Article Z: This Article, submitted by the Planning Board, would
\nincrease certain fees for applications made to the Planning Board, pursuant
\nto Article 6-18 of the Hanover General Bylaws, as amended at the May 2008
\nAnnual Town Meeting, which requires Town Meeting approval for fee increases.<\/p>\n
