Dear fellow Hanoverians:<\/p>\n
File this under “in case you missed it”! It is a busy time of the year, so
\nI would not be surprised. :) On Monday, December 18th, at 7:00 p.m. there
\nwill be a Special Town Meeting at Hanover High School Auditorium. Please
\njoin us as this is an important issue for the town.<\/p>\n
Last November, we were the second highest “no” vote total in the
\nCommonwealth regarding the legalization of recreational marijuana. By a
\nvote of 58% to 42%, we voted against the measure. As you surely know,
\nhowever, the ballot question won state-wide, and recreational marijuana is
\ncoming to Massachusetts next year.<\/p>\n
Cities and towns that voted against recreational marijuana, like Hanover,
\nnow can choose whether or not to allow recreational marijuana sales within
\ntheir borders.<\/p>\n
There are two questions on the warrant next Monday, as follows:<\/p>\n
ARTICLE 1. PROHIBITION ON MARIJUANA ESTABLISHMENTS \u2013 ZONING BYLAWS
\nIn accordance with Massachusetts General Laws Chapter 94G, Section 3(a)(2),
\nall types of marijuana establishments, as defined in Massachusetts General
\nLaws Chapter 94G, Section 1 and as may otherwise be defined by
\nMassachusetts law or regulation, to include, without limitation, all
\nmarijuana cultivators, marijuana testing facilities, marijuana product
\nmanufacturers, marijuana retailers, on-site consumption of marijuana at a
\nmarijuana retailer location, any other types of licensed marijuana-related
\nbusinesses, and the conducting of any such activity for commercial purposes
\nby whichever name used, shall be prohibited within the Town of Hanover.
\nThis prohibition shall not be construed to affect the medical use of
\nmarijuana as expressly authorized by the provisions of Chapter 369 of the
\nActs of 2012 and 105 CMR 725.000, as may be amended from time to time, or
\ntake any other action relative thereto.<\/p>\n
As of this writing (Saturday morning), the motion on this article will be:<\/p>\n
We move that the Town of Hanover amend the Town of Hanover Zoning Bylaws to
\ninclude the following as: <\/p>\n
Section 6.16.0 – PROHIBITION ON MARIJUANA ESTABLISHMENTS. <\/p>\n
In accordance with Massachusetts General Laws Chapter 94G, Section 3(a)(2),
\nall types of marijuana establishments, as defined in Massachusetts General
\nLaws Chapter 94G, Section 1 and as may otherwise be defined by
\nMassachusetts law or regulation, to include, without limitation, all
\nmarijuana cultivators, marijuana testing facilities, marijuana product
\nmanufacturers, marijuana retailers, on-site consumption of marijuana at a
\nmarijuana retailer location, any other types of licensed marijuana-related
\nbusinesses, and the conducting of any such activity for commercial purposes
\nby whichever name used, shall be prohibited within the Town of Hanover.
\nThis prohibition shall not be construed to affect the medical use of

In order for the Zoning Article to pass, it needs a 2\/3 vote. In order for
\nthe General By-Law Article to pass, it needs a simple majority. Given our
\nvote in November 2016 (of 58% against and 42% in favor), that makes turnout
