PLANNING BOARD
NOTICE OF PUBLIC HEARING
Notice is hereby given pursuant to Massachusetts General Laws Chapter 40A,
Section 5 (The Zoning Act), that the Planning Board of the Town of Hanover
will hold a Public Hearing on Monday, March 9, 2009 at 7:00 p.m. in the
first floor hearing room of the Town Hall, 550 Hanover Street, Hanover, MA.
The purpose of the Public Hearing is to hear testimony and comment from
interested persons relative to proposed amendments and additions to the
Zoning Bylaw and General Bylaws for the Town of Hanover, said amendments
having been included as Articles on the Warrant for consideration and action
at the Annual Town Meeting to be convened at the Hanover High School on
Monday, May 4, 2009. After the Public Hearing the Board will, as required
by law, vote its recommendations on the proposed articles and report them to
the Town Meeting.
There are ten (10) Articles proposing amendments to the Zoning Bylaw and
related General Bylaws for the Town which pertain to zoning and planning. A
summary of the proposed Articles is provided below. Copies of the text of
such Articles and maps thereof are available for review by interested
parties in the Offices of the Town Clerk and of the Planning Board (550
Hanover Street, Hanover, MA 02339) during regular business hours, 8AM to
4PM, Monday through Friday. The Article items appearing below may not be
the same as those on the final Warrant for the Annual Town Meeting, and are
inserted herein for convenience and discussion purposes only.
Summary of Proposed Zoning Articles:
Article A: This Article, submitted by Petition, would amend the
Zoning Bylaws of the Town, by changing photocopying, hairdressing and beauty
shops from uses which are currently prohibited within the Town’s Aquifer
Protection Zone to uses which are permitted, subject to a issuance of a
Special Permit from the Planning Board.
Article B: This Article, submitted by the Planning Board, would amend
the Zoning Bylaws of the Town, by decreasing the amount of parking spaces
required based on retail space within the Planned Shopping Center District,
where the Hanover Mall is located. The proposed change would allow the
conversion of excess parking lot areas into useable building space.
Article C: This Article, submitted by the Planning Board, would amend
the Zoning Bylaws of the Town, by requiring a Special Permit to operate a
Body Art or Tattoo Establishment, and by requiring such uses to be located
within the existing Adult Use Zoning District.
Article D: This Article, submitted by the Planning Board, would amend
the Zoning Bylaws of the Town, by requiring a Special Permit and Site Plan
Approval to construct and operate a Wind Turbine in the Town in any Zoning
District. Currently no regulations are in place for Wind Turbine uses.
Article E: This Article, submitted by the Planning Board, would amend
the Zoning Bylaws of the Town, by allowing Assisted Living Facilities within
the Planned Shopping Center District, where the Hanover Mall is located,
subject to issuance of a Special Permit from the Planning Board.
Article F: This Article, submitted by the Planning Board, would amend
the Zoning Bylaws of the Town, by allowing wetland resource and riverfront
area in the calculation of dimensional regulations within the Planned
Shopping Center District.
Article G: This Article, submitted by Petition, would amend the
Zoning Bylaws of the Town, consistent with Chapter 169 of the Acts of 2008
(An Act Relative to Green Communities) to provide for the as-of-right siting
of renewable or alternative energy research and development facilities, and
renewable or alternative energy manufacturing facilities within the
industrially zoned Fireworks District, subject to Site Plan Approval by the
Planning Board.
Article H: This Article, submitted by Petition, would amend the Zoning
Bylaws and Zoning Map of the Town, by changing the Zoning Designation of the
westerly portion of parcel 48-006 (596 Washington Street) from Residence A
District to Commercial District, so that the entire parcel shall be zoned
Commercial District.
Article I: This Article, submitted by The Board of Selectmen would
amend the Zoning Bylaws of the Town, to require that the setback for all
fences and corrals meant for animal and livestock containment meet the
front, side and rear setback requirements for structures under the Zoning
Bylaw.
Summary of Proposed Non-Zoning Articles:
Article Z: This Article, submitted by the Planning Board, would
increase certain fees for applications made to the Planning Board, pursuant
to Article 6-18 of the Hanover General Bylaws, as amended at the May 2008
Annual Town Meeting, which requires Town Meeting approval for fee increases.
