Planning Board Public Hearing

Dear fellow Hanoverians:

PLANNING BOARD NOTICE OF PUBLIC HEARING

Notice is hereby given pursuant to Massachusetts General Laws Chapter 40A,
Section 5 (The Zoning Act), that the Planning Board of the Town of Hanover
will hold a Public Hearing on Monday, March 15, 2010 at 7:00 p.m. in the
first floor hearing room of the Town Hall, 550 Hanover Street.

The purpose of the Public Hearing is to hear testimony and comment from
interested persons relative to proposed amendments and additions to the
Zoning Bylaws for the Town of Hanover, said amendments having been included
as Articles on the Warrant for consideration and action at the Annual Town
Meeting to be convened at the Hanover High School on Monday, May 3, 2010.
After the Public Hearing the Board will, as required by law, vote its
recommendations on the proposed articles and report them to the Town
Meeting.

There are five (5) Articles proposing amendments to the Zoning Bylaws for
the Town. A summary of the proposed Articles is provided below. Copies of
the text of such Articles and maps thereof are available for review by
interested parties in the Offices of the Town Clerk and of the Planning
Board (550 Hanover Street) during regular business hours: 8:00 a.m. to 4:00
p.m., Monday, Tuesday and Thursday; 8:00 a.m. to 8:00 p.m. Wednesday, and
8:00 a.m. to 12:00 noon on Friday. The Article items appearing below may not
be the same as those on the final Warrant for the Annual Town Meeting, and
are inserted herein for convenience and reference purposes only. Questions
regarding these articles may be directed to the Hanover Town Planner at
(781) 826-7641. Copies of the current Zoning Bylaws are available on the
Hanover website at www.hanover-ma.gov .

Summary of Proposed Zoning Articles:

Article A: This Article, submitted by the Planning Board, would amend the
Zoning Bylaws of the Town, by adopting and reenacting provisions and
regulations regarding the establishment and operation of so-called "Adult
Uses" within the Town. The purpose and intent of these regulations is to
address and mitigate the possible adverse secondary effects of such Adult
Uses. The purpose is not to infringe upon rights and protections provided by
the First Amendment of the Constitution of the United States of America. The
proposed Article makes no changes to the existing boundaries of Hanover’s
Adult Use District (an overlay zoning district).

Article B: This Article, submitted by the Parks and Recreation Committee,
would amend the Zoning Bylaws of the Town, by removing restrictions
regarding the location and approval of municipal recreational facilities in
the Residence A District of the Town, so that any such uses will be allowed
as-of-right.

Article C: This Article, submitted by the Sign Bylaw Committee, would amend
the General Bylaws of the Town by amending Section 6-9 (entitled "Sign
Bylaw") by adding additional terms and changing regulations regarding
permitted signs within the Town or by deleting the entire Section entitled
"Sign Bylaw" and replacing said section with a new Sign Bylaw, dividing the
Town into districts for the purpose of sign regulation and specifying new
requirements for signage accordingly.

Article D: This Article, submitted by Petition, would amend the Zoning
Bylaws and Zoning Map of the Town, by deleting Section 6.12 of the Hanover
Zoning Bylaws (entitled "Interchange District") in its entirety and
replacing it with a new section which provides for changes in dimensional
and use requirements and restrictions. Specifically, the proposed Article
would allow for: lesser buffer and setback areas between development within
the district and on abutting properties when compared to the existing bylaw;
increased building heights (not to exceed seven [7] stories) within six
hundred (600) feet of Route 3 and Route 53; allowance for unrestricted
multi-family residential developments within the district; and allowance for
unrestricted retail stores and service establishments within the district.

Article E: This Article, submitted by Petition, would amend the Zoning
Bylaws and Zoning Map of the Town, by changing the Zoning Designation of the
westerly portion of parcels 48-007 and 48-016 (as shown on the Hanover
Assessors’ Maps (572 Washington Street) from Residence A District to
Commercial District, so that the entire of both parcels shall be zoned
Commercial District.
